SUPERIOR COURT

Alleged shooter charged with unlawful firearm possession

A Moses Lake man arrested for allegedly shooting at another man in Cascade Valley last Friday, March 27, pled not guilty to second-degree unlawful possession of a firearm during an appearance Monday, March 30, in Grant County Superior Court.

Judge Anna Gigliotti released the defendant, 49-year-old Cedrick Denard Small, on his own recognizance pending a June 17 trial.

According to a report by the Grant County Sheriff’s Office, Small was accused of displaying a handgun and shooting at 59-year-old Richard E. Gillespie, who had been repairing a garage door at a residence in Cascade Valley around 4:40 p.m. last Friday. Gillespie, who was not injured in the incident, alleged that Small arrived at the location in a white Ford Ranger pickup just as Gillespie was preparing to drive away in his own truck.

Gillespie told deputies he heard a gunshot and feared for his life as he fled the scene. Deputies later located Small around 5 p.m. at his residence in the Larson housing area. When questioned, Small denied leaving his home in the past hour or letting anyone drive a white Ford Ranger pickup parked at the location. Deputies said the hood of the truck was warm to the touch, indicating it had recently been driven.

The sheriff’s report did not say whether a weapon was located or specify a possible motive for the alleged shooting.

Small, who has a prior criminal history, was arrested and booked into the Grant County Jail. The Grant County Prosecutor’s Office charged him with second-degree assault with a deadly weapon and second-degree unlawful possession of a firearm because of a prior conviction.

However, during Monday’s hearing, Gigliotti did not find probable cause to charge Small with assault; only the firearm possession violation. Court documents did not specify a basis for her ruling.
